Welcome to Sleepyhead Alarm Clock by So Curious LLC. These Terms of Service (“Terms”) govern your use of our mobile application and related services (the “App”). By accessing or using the App, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree to these Terms, you should not use the App.
1. Acceptance of Terms
By downloading, accessing, or using the App, you confirm that you are legally capable of entering into binding contracts and that you accept these Terms in full. If you disagree with any part of these Terms, please discontinue your use of the App immediately.
2. Eligibility
The App is intended for users who are at least 13 years of age. If you are under 18, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. User Responsibilities
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App in any way that breaches any applicable local, national, or international law or regulation.
- Engage in harmful, abusive, or disruptive behavior while using the App.
- Attempt to gain unauthorized access to the App or any of its features.
- Share false or misleading information or impersonate others while using the App.
4. User-Generated Content
You are solely responsible for the content you upload, share, or otherwise make available through the App, including but not limited to voice messages, text, and profile information (“User Content”). You represent and warrant that your User Content does not violate any applicable law, infringe any third-party rights, or breach these Terms.
So Curious LLC reserves the right to review, monitor, and/or remove any User Content that violates these Terms or is otherwise deemed inappropriate at our sole discretion.
5. No Liability for Interactions
The App facilitates the exchange of voice messages between users. So Curious LLC does not monitor or control user interactions. By using the App, you acknowledge and agree that any interactions you have with other users, including the receipt of voice messages, are entirely at your own risk. So Curious LLC is not liable for any damages, losses, or disputes arising from interactions with other users, including but not limited to offensive, inappropriate, or harmful content in voice messages.
6. Modifications to the Service
So Curious LLC reserves the right to modify, suspend, or discontinue any aspect of the App, including any features or content, at any time without notice. We are not liable for any such changes or disruptions to the App.
7. Premium Services
The App may offer premium services that require payment. All fees for premium services are non-refundable unless otherwise stated by applicable law. By purchasing a premium subscription, you agree to comply with the terms set forth by third-party payment processors (such as Apple or Google) as well as these Terms.
8. Privacy
Our Privacy Policy outlines how we collect, use, and share information related to your use of the App. By using the App, you consent to the practices described in our Privacy Policy.
9. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, whether express or implied. So Curious LLC does not warrant that the App will meet your requirements, be available at all times, or operate without interruption.
Limitation of Liability: To the fullest extent permitted by law, So Curious LLC and its directors, employees, partners, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages. This includes but is not limited to damages for lost profits, data loss, personal injury, or emotional distress resulting from:
- Use or inability to use the App.
- Interactions or communications with other users of the App.
- Unauthorized access, use, or alteration of your transmissions or content.
10. Indemnification
You agree to indemnify, defend, and hold harmless So Curious LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or related to your use of the App, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
So Curious LLC reserves the right to terminate or suspend your account at any time, with or without cause, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the App will cease immediately.
12. Dispute Resolution
Any disputes arising under these Terms or related to the App will be governed by the laws of the State of California, without regard to conflict of laws principles. Any legal action or proceeding will be resolved exclusively in the state or federal courts located in California.
13. Changes to Terms
So Curious LLC reserves the right to update or modify these Terms at any time. When changes are made, we will update the “Last Updated” date at the top of this page. Continued use of the App after any changes constitute your acceptance of the revised Terms.
